Jury Trial Required for Sign Code Violation. Charge is a Misdemeanor.

The Board of Trustees has amended the village code.  Violations of the village code are no longer misdemeanors and there will never be a need to impanel a jury to resolve these cases.

The owner of Shock Ice Cream has been charged with violating the Village’s sign ordinance.  The village code declares this to be a misdemeanor that would result in a criminal conviction and is punishable with up to six months in jail.  Westhampton Beach Village Code §197-83 B

Village officials have declared their desire to have the proprietor pay the maximum fine, but because she could serve six months in jail this case, by law, will require a jury trial unless waived by the proprietor in writing in open court.

Progress for WHB finds this local law to to be inconsistent with the spirit of mutual respect and cooperation required in any community.  The local law should be changed now.
